آليات عمل المجلس الدستوري والمحكمة الدستورية بين التطابق والتمايز The Work Mechanisms Of The Constitutional Council And The Constitutional Court Between Congruence And Differentiation

الملخص
يعد الدستور أسمى القوانين في الدولة الحديثة، ويعتبر احترام القوانين وتطبيقها على الجميع من المبادئ العامة لبناء دولة المؤسسات، فالدستور يحدد طبيعة النظام السياسي في الدولة، والحامي بمبادئه للحقوق والحريات الأساسية للأفراد، والمنظم لاختصاصات المؤسسات والهيئات الدستورية في الدولة، حيث نجد ان المؤسس الدستوري انشأ هيئة دستورية دورها الرقابة على مدى دستورية القوانين سماها المجلس الدستوري، اقرها في دستور 1963، واغفلها في دستور 1976، وأعاد النص عليها في دستور 1989 بعد كل ما جاء من تحولات سياسية، اقتصادية واجتماعية، كما ان كل التعديلات الدستورية التي تلت دستور 1989 الى غاية التعديل الدستوري لسنة 2020، والذي جاء هو الاخر بتغير لهذه الهيئة الدستورية من (المجلس الدستوري) الى مؤسسة دستورية واعطاها اسم المحكمة الدستورية. The constitution is the supreme law of the modern state, and respect for laws and their application to everyone is one of the general principles for building a state of institutions. The constitution defines the nature of the political system in the state, and it is the protector, with its principles, of the basic rights and freedoms of individuels, and the regulator of the functions of the constitutional institutions and bodies in the state. Where we find that the constitutional founder established a constitutional body whose role is to monitor the constitutionality of laws and called it the Constitutional Council, and approved it in a constitution of 1963. and omitted it in the constitution of 1976. And restate it in the constitution of 1989, After all the political, economic and social transformations, as well as all the constitutional amendments that followed the constitution of 1989. Until the constitutional amendment of the year of 2020. Which also came with changing this constitutional body from the constitutional Council to a constitutional institution, and gave the name of the constitutional court.
