خصوصية القسمة في العقار الفلاحي

الملخص
الملخص تتميز القسمة الواقعة على العقار الفلاحي الخاص بنوع من الخصوصية عن باقي القسمة الواقعة على العاقرات بصفة عامة ،نضرا لارتباط الملكية بالوظيفة الاجتماعية و تحقيق الصالح العام بتنمية الاقتصاد الوطني عن طريق الاستثمار الأمثل ،و لا يكون ذالك إلا بحماية العقار الفلاحي من التفتيت و قسمته لمساحات ضئيلة، لذا نص المشرع الجزائري ضمن قانون التوجيه العقاري 90/25 و المرسوم التنفيذي 97/490 على قيد التجزئة و قسمة العقار الفلاحي باحترام المساحة المرجعية ،فيلتزم الأفراد كما تلتزم الهيئات المشرفة المتمثلة في القضاء و الموثقين باحترام قيد قسمة العقار الفلاحي ، في حالة ان تمت القسمة دون احترام المساحة المرجعية تتدخل الدولة بموجب هيئاتها المتمثلة في الديوان الوطني للاراضي الفلاحية بتوقيع جزاءات على المالك التي تصل إلا حد تجريده من ملكيته بالبيع الجبري مع ممارستها لحق الشفعة الادارية الكلمات المفتاحية :عقار فلاحي ، قسمة احترام المساحة المرجعية ،قيد القسمة و التجزئة ، المرسوم التنفيذي 97/490،خبرة قضائية Résumè La division dans foncier agricole est différente de la division dans d'autres immobilier car les terres agricoles visent à remplir la fonction sociale et les intérêts de l'individu de développer l'économie nationale par le biais d'investissements agricoles. Par conséquent, le législateur algérien a précisé les conditions de la division des terres agricoles dans la loi 90/25 et le décret exécutif 97/490. Les particuliers et les organismes représentés par le pouvoir judiciaire et les notaires doivent appliquer les conditions de la division et de la division.
