الملخص
ملخص: تعالج هذه الورقة البحثية حق الطفل في التنمية، حيث يعتبر موضوع حماية الطفل المحضون من أهم المسائل الحيوية والهامة في مجال شؤون الأسرة، لا سيما بعد انحلال الرابطة الزوجية، خاصة أن هذا الطفل أولى برعايته سواء من الناحية المادية أو الأدبية، بالإضافة إلى توفير الخدمات اللازمة من أجل نمو الطفل صحياً وثقافياً وروحيا وعليه، فقد تحدث نزاعات بين الحاضنين من أجل توفير الجو الملائم لتنمية الطفل المحضون، لهذا فقد وضع المشرع الجزائري ركيزة أساسية يعتمد عليها قاضي شؤون الأسرة لحل مشكلة الحضانة متمثلة في تغليب مصلحة المحضون. من هنا، فإن المشرع يجيز استئناف الأحكام القضائية المتعلقة بالحضانة طبقا لأحكام المادة 57 في فقرتها الثانية من الأمر 05 - 02، كما يجيز رقابة المحكمة العليا على تطبيق القانون في المنازعات المتعلقة بمصلحة المحضون. Abstract: This research paper deals with the right of the child to development, as the issue of the protection of the cuddled child is considered one of the most vital and important issues in the field of family affairs, especially after the dissolution of the marital bond, especially since this child is the first to take care of him, whether in terms of material or moral, in addition to providing the necessary services For the healthy, cultural and spiritual development of the child. Accordingly, disputes may occur between the custodians in order to provide the appropriate atmosphere for the development of the cuddled child. For this reason, the Algerian legislator has established a basic pillar on which the family affairs judge relies on solving the custody problem represented in giving priority to the interests of the cuddled. Hence, the legislator permits the appeal of judicial rulings related to custody in accordance with the provisions of Article 57 in its second paragraph of Ordinance 05-02, and it also permits the Supreme Court’s oversight of the application of the law in disputes
