الرقابة القضائية على أعمال رئيس الجمهورية في النظام الدستوري الجزائري

الملخص
إن الرقابة القضائية ضرورية بصفة عامة مهما كان المجال والمستوى الذي يتخذ فيه العمل، أو التصرف، ومن هذا المنطلق تظهر أهمية الرقابة القضائية في ارساء دعائم دولة القانون،وبذلك تعد الرقابة القضائية من أكثر صور الرقابة فعالية كونها بعيدة عن الأهواء الحزبية، ومن خلال هذه الدراسة نحاول تبيان مجال وحدود الرقابة القضائية على أعمال رئيس الجمهورية بصفته الممثل الوحيد للأمة المنتخب بالاقتراع العام والمكلف دستوريا بالسهر على احترام أحكام الدستور،علاوة على ذلك يتم بحث مختلف الوسائل المنظمة والضابطة لإطار الرقابة على أعمال رئيس الجمهورية. Abstract: Judicial control is generally necessary, regardless of the field and level in which the work or the behavior is taken. From this point of view, the importance of judicial control appears in laying the foundations of the rule of law, and thus judicial control is one of the most effective forms of control as it is far from partisan whims,Through this study, we try to show the scope and limits of judicial control over the actions of the President of the Republic as the only representative of the nation elected by universal suffrage and constitutionally charged with ensuring respect for the provisions of the Constitution,In addition the various regulating and controlling means of the supervision framework over the actions of the President of the Republic.
