الاختصاص العقابي لسلطات الضبط العاملة في القطاع المالي والضمانات القانونية المكفولة

الملخص
بتخلي الدولة عن النهج الاشتراكي وتبني النهج الرأسمالي تنازلت عن التدخل وضبط النشاط الاقتصادي لهيئات تتمثل في سلطات الضبط المستقلة التي أوكل لها القانون مهام تشمل التنظيم والمراقبة والعقاب كذلك. وقد أنشأ المشرع سلطات لضبط القطاع المالي تختص بتنظيمه ومراقبته وكذا القضاء بعقوبات في حالة صدور إخلال من طرف الأشخاص العاملين فيه. إعطاء هذه السلطات اختصاص عقابي شبيه بذلك الممنوح للقضاء –الجنائي- يجب أن يكون مصحوبا بالضمانات القانونية التي تكفل للشخص المتابع الحق في محاكمة عادلة. By abandoning the socialist approach and adopting the capitalist approach, the state has relinquished the intervention and control of economic activity to bodies represented in the independent control authorities assigned by the legislator with tasks that include regulation, control and punishment as well.
