الرؤية الحديثة لحماية حقوق الإنسان من منظور الفكر الإسلامي

الملخص
تصور الإسلام للحريات وحقوق الإنسان يجسد معالم النظرة الشمولية المتكاملة التي يوليها للإنسان وهي نظرة كلها تكريم، خاصة وأن الإسلام قد أعطى تصورات ومفاهيم وتشريعات قائمة على مبادئ ثابتة وأسس قوية ودعائم متينة، جعلت منه الدين الصحيح السليم الذي ينبغي الأخذ به في مناحي الحياة: السياسية، الاجتماعية، الاقتصادية، العلمية. و في الوقت الذي يشتد فيه الجدل والنقاش حول موضوع الحريات وحقوق الإنسان من منظار التصور والفكر الاسلامي مقارنا كل ذلك بما يطرحه الفكر الغربي في هذه المسائل وبالأخص ما طرح في الوثيقة العالمية الصادرة عن الأمم المتحدة سنة 1948 والمعـــــــــــروفة بـ"الإعلان العالمي لحقوق الإنسان"، تأتي مداخلتنا كورقة بحثية نحاول من خلالها وضع التصورات الحديثة في مجال حماية حقوق الإنسان من منظار الشريعة وما السبل إلى توظيفها كآلية تجد طريقها للتطبيق في الأنظمة القانونية الداخلية أو الدولية، وهذا على اعتبار أن هذه القضيــــــــة أضحت حاليا من القضايا الأكثر تفجرا وحيوية، لأنها تمس أوضاع ومصالح ملايين المسلمين داخل دولهم بصفة عامة والبشر بصفة عامة. The Islamic conception of freedoms and human rights embodies the features of an integral and comprehensive view to which the human being attaches a great importance. It is a view that honors man, especially since Islam has given perceptions, concepts and legislation based on firm principles, strong foundations and solid grounds, which made it a correct and sound religion that should be adopted in all aspects of life: political, social, economic, and scientific. At a time when controversy and debate on the issue of freedoms and human rights from the perspective of Islamic thinking and thought intensifies, comparing all this to what Western thought poses in these issues, especially what was presented in the global document issued by the United Nations in 1948, known as the “Universal Declaration of Human Rights”. Our intervention in this research paper is an attempt to develop modern perceptions in the field of human rights protection from the perspective of Sharia and the ways to implement it as a mechanism that finds its way to be applied in internal or international legal systems. This is especially true given that this issue has now become one of the most explosive and vital issues, because it affects the conditions and interests of millions of Muslims within their countries in general and those of human beings in general.
