Construction Permit A Method To Control Urban Activity

Abstract
Abstract The Algerian legislator, imposed a construction permit for several resent, including fighting chaotic buildings, observing the rules of construction and building, creating and maintaining a harmonious urban. This can only come through imposing control over every construction process whatever its nature. With prior censorship through autorisation for the three parties, according to the nature of the buildings, namely they are the President of the Municipal commission Assembly, the Governor of the State, or the Minister in charge of reconstruction. However, when the administration uses its authority by granting or rejecting the construction permit, may exceed its validity and be issue illegal decisions, whether in the face of the license applicant or in the face of others, either refusal or granting the license without taking into account the legal or regulatory conditions, in this case resorting to the competent administrative court remains the only recourse to claim those judgments for cancellation and even to demand damages from the administration if it has a reason فرض المشرع الجزائري كغيره من المشرعين رخصة البناء لعدة اهداف منها محاربة البناءات الفوضوية ،مراعاة قواعد التعمير و البناء ، خلق و الحفاظ على نسيج عمراني متناسق ذلك لا يتأتى الا خلال فرض رقابة قبلية على كل عملية بناء او تشييد مهما كانت طبيعتها . هذه الرقابة القبلية لعمليات البناء من خلال الترخيص المسبق لها مخولة لجهات ثلاثة بحسب الاحوال و بحسب طبيعة البنايات و هي رئيس المجلس الشعبي البلدي او والي الولاية او الوزير المكلف بالتعمير .غير ان الادارة و هي تستعمل صلاحياتها في الرقابة من خلال منح او رفض رخصة البناء قد تتجاوز صلاحيتها و تصدر قرارات غير مشروعة ،في هذه الحالة فان اللجوء الى القضاء الاداري المختص يبقى هو الملاذ الوحيد للطعن في تلك القرارات بالإلغاء بل و حتى مطالبة الادارة بالتعويضات ان كان لها موجب .
