الجوانب القانونية لدور سلطات الضبط المستقلة في حماية المستهلكين

الملخص
يهدف الموضوع الى توضيح بعض جوانب نشاط سلطات الضبط المستقلة في مجالات اقتصادية هامة تحقق المصلحة العامة وتحقق كذلك مصلحة الزبائن المنتفعين كمستهلكين من خدمات هذه القطاعات ومثالها سلطة البريد المواصلات وسلطة التامين وسلطة الكهرباء والغاز . توصلت الدراسة ان قطاعات الضبط المستقلة تخضع الى قانون السوق وبالتالي حتمية وجود علاقة بينها وبين مجلس المنافسة الذي يسهر على تحقيق مبدأ المنافسة الحرة، وإن دورها في حماية المستهلكين يظهر في بعض الجوانب القانونية منها ما يتعلق بسلطة الرقابة التي تمارسها على ممارسة انشطتها ناهيك عن سلطة العقاب التي تقوم بها في هذا الخصوص. The prupose of the topic is to clarify certain aspects of activity of Independent Regulatory Authorities in important economic areas that serve the general interest as well as the interest of the customers who benefit from the services of these sectors, such as the postal and transport authority, the insurance authority and the electricity and gas authority. The study revealed that the Independent Regulatory Authorities are subject to the law of the market and that it is therefore imperative to have a relationship with the Competition Council, which guarantees the realisation of the principle of free competition, and that their role in consumer protection is reflected in certain legal aspects, including the power of control that they exercise in the exercise of their activities, not to mention the power of sanction that they exercise in this respect. key words: regulatory authorities, consumers, Competition Council, postal authority, electricity and gas authority.
