الملخص
ملخص: تعد الضمانات هي مجموعة القنوات والوسائل التي يمنحها القانون للشخص لكي يتمتع بموجبها بحقوقه وتحميها وتكون له الحرية في أن يستعمل هذه الوسائل أو لا يستعملها دون أن يترتب على ذلك الإخلال التزام قانوني. لقد أخذت المحكمة الجنائية الدولية بضمانات المحاكمة العادلة حيث نصت على العديد من الضمانات منها مبدأ الشرعية في التجريم والعقاب، والمساواة بين الجميع أمام القضاء وقرينة البراءة وعلنية المحاكمة وإبلاغ المتهم بالتهم الموجهة إليه، وأن يأخذ الوقت الكافي لتحضير دفاعه وحقه في أن يحاكم دون تأخير لا مبرر له، فضلا عن محاكمته حضوريا، وحقه في استجواب الشهود، وحقه في الاستعانة بمترجم، وحقه في أن يلزم الصمت وغيرها من الضمانات التي كرسها النظام الأساسي للمحكمة الجنائية الدولية وأن تقرر في حقه العقوبات المحددة سلفا بنص القانون دون غيرها من العقوبات وفق آليات قانونية واضحة ومحددة. Abstract: Guarantees are the set of channels and means granted by law to a person in order to enjoy and protect his rights and be free to use these means or not to use them without entailing a legal obligation. The International Criminal Court has adopted the guarantees of a fair trial, as it stipulated many guarantees, including the principle of legality in criminalization and punishment, the equality of all before the judiciary, the presumption of innocence, the publicity of the trial, informing the accused of the charges against him, taking sufficient time to prepare his defense and his right to be tried without undue delay He has, in addition to being tried in his presence, his right to question witnesses, his right to the assistance of an interpreter, his right to remain silent and other guarantees enshrined in the Statute of the International Criminal Court and to decide against him the penalties predetermined by the text of the law without other penalties in accordance with clear and specific legal mechanisms .
