الملخص
الملخص: تشكل جريمة الصرف، جريمة يعاقب عليها القانون الجزائري، نظرا للأضرار الخطيرة التى تلحق بالمجتمع والاقتصاد الوطني، الأمر الذي يغلب تكييفها ضمن الجرائم الاقتصادية نظراً لمحل الجريمة والأفعال المادية المشكلة لها. اهتم المشرع الجزائري بهذا النوع من الجرائم و الحد منها بقوانين خاصة دون قانون العقوبات ، حيث يعتبر الأمر رقم 96-22 المتعلق بقمع مخالفة التشريع و التنظيم الخاصين بالصرف و حركة رؤوس الاموال من و الى الخارج ، المعدل و المتمم بالأمر رقم 03-01 المتعلق بقمع محالفة التشريع و التنظيم الخاصين بالصرف و حركة رؤوس الأموال من و إلى الخارج ، وبموجب القانون رقم 06-24 المتضمن لقانون المالية لسنة 2007 وكذا بمقتضى الأمر رقم 10-04 المؤرخ في 26 أوت 2010 الذي هو بمثابة النص المرجعي وحجر الزاوية لتنظيم وضبط جرائم الصرف بإحكام. فتقوم جريمة الصرف إذا تم خرق هذه النصوص القانونية وعدم احترامها. الكلمات المفتاحية: جريمة الصرف، الجريمة الاقتصادية، التكييف القانوني، المشرع الجزائري. Abstract: The foreign exchange offense constitutes an offense punishable by Algerian law, given the serious damage caused to society and the national economy, which is often considered an economic offense, given the location of the offense and the material acts. which constitute it. The Algerian legislator took an interest in this type of offense and limited it by special laws without a penal code. Ordinance No. 96-22 relating to the repression of infringements of the laws and regulations on foreign exchange and capital movements from and to abroad, amended and supplemented by Ordinance No. 03-01 on the abolition of the opposition between the legislation and the regulation of foreign exchange and capital movements from and to abroad, and in accordance with law n ° 06-24 on the 2007 finance law, as well as ordinance n ° 10- 04 of August 26, 2010, which is the reference text for supervising and closely monitoring the foreign exchange offense. The currency offense will only arise if these legal texts are violated and not respected. Key words : exchange offense, economic offense, legal qualification, Algerian legislator.
