الملخص
يتناول هذا المقال بالدراسة المسؤولية الدولية لفرنسا عن تجاربها النووية في الجزائر وذلك استنادا إلى القانون الدولي، حيث تكمن أهمية هذا الموضوع في إبراز مدى بشاعة الجرائم التي ارتكبتها السلطات الفرنسية في حق الشعب الجزائري، وتتمحور إشكالية البحث حول الأساس القانوني الذي تقوم عليه المسؤولية الدولية لفرنسا عن تجاربها النووية في الجزائر، وتوصلت إلى أن التجارب النووية الفرنسية في الجزائر هي جريمة دولية مكتملة الأركان، وهي خرق واضح وصريح لقواعد القانون الدولي الذي يحرم الإبادة الجماعية، وهي أساس قيام المسؤولية الدولية في حق السلطات الفرنسية مما يتطلب الاعتراف بجرائمها وتعويض المتضررين. This article examines the international responsibility ofFrance for its nuclear experiments in Algeria based on international law, as the importance of this topic lies in highlighting the extent of the ugliness of the crimes committed by the French authorities against the Algerian people, and the problem of research revolves around the legal basis on which international responsibility is based about its nuclear tests in Algeria, and concluded that the French nuclear tests in Algeria are a full-fledged international crime, which is a clear violation of the rules of international law that criminalizes genocide, and is the basis for establishing international responsibility against the French authorities, which requires them to recognize their crimes and compensate those affected.
