فعالية الحق في العدول كآلية قانونية لحماية المستهلك الإلكتروني

الملخص
لقد كان لتطور تكنولوجيا الاتصال أثر بالغ الأهمية في مجال إبرام العقود بين الأشخاص، حيث أدى إلى ظهور نوع جديد من المعاملات التي تتم بالوسائل الإلكترونية وخاصة عبر شبكة الإنترنت، إذ أصبحت تعرف انتشاراً كبيراً في الوقت الراهن كما يعتبر من أخطر المعاملات التعاقدية المعاصرة والذي يُعد عقد الإستهلاك الإلكتروني من أبرز هذه العقود على اعتبار أن المستهلك يُقبل على إبرام مثل هده العقود مع المهني على وجه السرعة لاقتناء السلعة أو الخدمة دون تفكير مع رؤية السلعة من خلال صورة على شاشة الحاسوب فقط، مع استعمال المهني لكل الوسائل الدعائية التي من شأنها جذب المستهلك والتأثير عليه، الأمر الذي اقتضى البحث عن آليات حمائية تتناسب مع هذه الآلية التعاقدية المستحدثة مما دعي العديد من التشريعات القانونية إلى النص على منح المستهلك الحق في العدول عن العقد بعد إبرامه والذي يُعتبر استثناء عن القاعدة العامة القوة الملزمة للعقد. The development of communication technology has had a very important impact in the field of concluding contracts between people, as it led to the emergence of a new type of transaction that is carried out by electronic means, especially via the Internet, It has become widely known today as it is considered one of the most dangerous contemporary contractual transactions Which is the electronic consumption contract of the most prominent of these contracts Considering that the consumer accepts such contracts with the professional as a matter of urgency to acquire the good or service without thinking, while seeing the commodity through a picture on the computer screen only, With the professional use of all advertising means that would attract and influence the consumer, Which necessitated the search for protective mechanisms commensurate with this innovative contractual mechanism, which called for many legal legislations to provide for the consume the right to withdraw from the contract after its conclusion, which is considered an exception to the general rule, the binding force of the contract.
