قاضي تطبيق العقوبات بين المحدودية وافاق التطوير

الملخص
استنبط المشرع الجزائري فكرة إحداث منصب قاضي تطبيق العقوبات للإشراف على تنفيذ العقوبة السالبة للحرية من خلال المشرع الفرنسي، حيث يمكن تعريفه على أنه قاضي متخصص ينتمي إلى محكمة الدرجة الثانية، يسهر على تنفيذ العقوبات المقضي بها، ويمكنه بعد استشارة لجنة تطبيق العقوبات أن يسمح بتقليص عقوبة المحبوسين الذين يتمتعون بسلوك حسن من أجل تربيتهم وإعادة إدماجهم اجتماعيا، كما يمثل هدفه في الإشراف على الأشخاص المحكوم عليهم ومتابعة سير حياتهم داخل وخارج المؤسسة العقابية ، كما أن لقاضي تطبيق العقوبات مكانة قانونية بارزة في مجال تنفيذ العقوبات تجعله مؤسسة قائمة بحد ذاتها. le legislateur algerien a eu l'idee de creer le poste de juge de l'application des peines pour contrôler l’execution des peines à travers le législateur français, où il peut être défini comme un juge spécialisé appartenant au tribunal de deuxième instance, qui assure l'application des peines décidées, et il peut, après avis de la commission de l'application des peines, permettre la réduction des peines pour les détenus ayant de bonnes conduites pour leur éducation et leur réinsertion sociale, et son objectif est d'encadrer les personnes condamnées et de suivre le déroulement de leur vie à l'intérieur et à l'extérieur de l'établissement pénitentiaire, le juge de l'application des peines occupe une place juridique prépondérante dans le domaine de l'application des peines qui fait de lui une institution à part entière.The Algerian legislator elicited the idea of creating the position of the enforcement judge of penalties to supervise the application of the penalties through the French legislator, where he can be defined as a specialized judge belonging to the court of the second instance, who ensures the application of the penalties decided upon, and he can, after consulting the penalties enforcement committee, allow penalties to be reduced for prisoners having good behavior for their education and social reintegration, and his goal is to supervise the sentenced persons and follow up the progress of their lives inside and outside the penal institution, the enforcement judge of penalties has a prominent legal position in the field of application of penalties that makes him an institution in itself.
