آليات الرقابة على تفويضات المرافق العامة للجماعات الإقليمية في ظل المرسوم التنفيذي رقم 18/199 المتضمن تفويضات المرفق العام

الملخص
يسعى المنظم الجزائري باللجوء إلى التحكم في نمط تسيير تفويضات المرافق العامة لضمان ترقية أداء الخدمات العمومية بإشراك منتفعي المرفق العام في الرقابة والتقييم. كما يعتبر نظام الرقابة على تفويضات المرفق العام وسيرها وآليات فض النزاعات بالطرق الودية بين أطراف إتفاقية التفويض من بين طرق التحكم في سير تفويض المرفق العام، وهذا لا يكون إلا بالتأكد من الإعتماد على الشروط المنصوص عليها في هذه الإتفاقية عند إتخاذ القرارات، وأيضا الخضوع للأنظمة والقوانين والإجراءات المقررة قانونا، منع حدوث الأخطاء والإنحرافات، وإكتشاف ما يقع منها، ثم إتخاذ الإجراءات التصحيحية اللازمة لمعالجتها ومنع تكرارها. The Algerian regulator seeks by recourse to control the mode of management of public service delegations to ensure the upgrading of the performance of public services by involving the beneficiaries of the public service in monitoring and evaluation. The system of control over the delegations of the public facility and its progress and mechanisms for resolving disputes by amicable means between the parties to the delegation agreement are among the methods of controlling the progress of the delegation of the public facility, and this can only be by ensuring that the conditions stipulated in this agreement are relied upon when making decisions, as well as compliance with the regulations and laws And the legally established procedures, preventing errors and deviations from occurring, discovering what occurs from them, and then taking the necessary corrective measures to address them and prevent their recurrence.
