حماية الأطفال ذوي الإعاقة في ظل المواثيق العالمية والعربية

الملخص
الملخص: أولت المواثيق العالمية والعربية اهتمامًا بحقوق الإنسان عمومًا، وأكدت على ضرورة أن يتمتع كل الأشخاص بكافة الحقوق، على قدم المساواة ودون أي تمييز. ولعل فئة الأطفال ذوي الإعاقة من بين الفئات التي يجب أن تتاح لها كافة الحقوق المتاحة للأشخاص الأصحاء، فضلاً عن أنهم يحتاجون إلى حماية خاصة، توفر لهم رعاية مميزة ومستمرة، تتلاءم مع نوع الإعاقة وتتطور بتطور المجتمعات. فالاهتمام الدولي بالأطفال ذوي الإعاقة راجع لخصوصية الطفل بالدرجة الأولى باعتباره الوحدة الأساسية واللبنة الأولى للمجتمع، وخصوصية ذوي الإعاقات بالدرجة الثانية، وفي هذا السياق يمكن طرح الإشكالية التالية: هل وفرت المواثيق العالمية والعربية الحماية الكافية للأطفال ذوي الإعاقة؟. وللإجابة عن هذه الإشكالية يتطرق هذا المقال لحماية الأطفال ذوي الإعاقة في ظل المواثيق العالمية والعربية. International and Arab legal instruments have paid attention to all human rights in general, and reiterated the need of all persons to enjoy all rights on an equal basis and without any discrimination. Children with disabilities are among the categories of persons that must enjoy the same rights available to persons who are not disabled. In addition disabled children need to be entitled to a special protection which provides them with a distinct and continuous care appropriate to the type of their disability and development of societies. It seems that the importance given to disabled children at the international level stems from the special place of children in society in general and from the specifities of children with disabilities in particular, in this context the main question that arises is whether both international and Arab legal instruments have provided disabled children with full protection ?. In order to answer this question therefore this article deals with the protection of disabled children under both international and Arab legal instruments.
