الملخص
شكل التقاضي الإلكتروني خطوة هامة في مجال العدالة، الأمر الذي دعى بضرورة مواكبة هذا التطور بإصلاح المنظومة القضائية الجزائرية بهدف النهوض بقطاع عدالة يستجيب بسرعة لمتطلبات المتقاضين. سنحاول من خلال هذه الورقة البحثية الحديث عن التقاضي الإلكتروني بالجزائر في إطار التكنولوجيا الحديثة، وذلك بتعريف التقاضي الإلكتروني وبيان مختلف الخصائص التي تميزه عن التقاضي التقليدي ومن ثم التطرق لواقع التقاضي الإلكتروني في الجزائر والذي جاء نتيجة عصرنة الجهاز القضائي، وكذى التحديات التي تواجهها في إطار تطبيقها للتقاضي الإلكتروني سواء من حيث الصعوبات التي تعيق التطبيق الأمثل لها، أو من حيث الآثار السلبية التي قد تترتب عن تطبيقه على ضمانات المحاكمة العادلة. الكلمات المفتاحية: التقاضي الإلكتروني، تكنولوجيا المعلومات، المحاكمة الإلكترونية، التقنية. Abstract: technology to deal with many judicial issues. This fact has implied the need to accompany this evolution by reforming the Algerian judicial system with the aim of relaunching a justice sector able to respond quickly to the needs of litigants, by introducing modern technology into judicial work to facilitate the right to have recourse to justice, and by providing all the modern technical means to the judge and to the professionals of the justice system in order to carry out their functions in the best possible way. Through this research paper, we will try to talk about electronic litigation in Algeria within the framework of modern technology, starting by defining electronic litigation and explaining the different characteristics that distinguish it from traditional litigation, and then addressing the reality of electronic litigation in Algeria as a result of the modernisation of the judicial system as well as the challenges it faces in the application of the e-litigation, both in terms of the difficulties that prevent its optimal implementation, and in terms of the negative effects that this implementation could have on the guarantees of a fair trial. key words: Electronic litigation, Information technology, Electronic trial, Technology.
