نظرية شغور الأملاك العقارية ودورها في التصدي للعقارات غير المطالب بها أثناء المسح

الملخص
مـلخـص: نتناول في موضوع الدراسة منهج الدولة في تسوية العقارات التي لا مالك لها وفقا لنظرية الشغور و حساب العقارات غير المطالب بها أثناء المسح؛ وذلك بالتعرض لمضمون هذه التسويات وأبعادها و الأهداف المرجوة من خلال تشريعها،والتي تصب في مجملها في الغاية المنشودة لمعظم الدول وهي تعميم نظام شهر عقاري واحد يضمن تأمين المعاملات العقارية و كفالة حقوق الملاك ناهيك عن تفعيل دور العقار على جميع الأصعدة. وخلصت هذه الدراسة إلى فاعلية نظرية الشغور في التصدي لوضعية العقارات غير المطالب بها أثناء المسح وتقليل آثار هذه الأخيرة على العقار نفسه لما فيها من تعطيل لدوره الفعال في الاقتصاد الوطني. الكلمات المفتاحية: العقارات غير المطالب بها أثناء المسح- الحماية القانونية للعقار- نظرية شغور الأملاك العقارية. In the subject of the study, we discuss the state’s approach to settling ownerless real estate according to the vacancy theory and calculating unclaimed real estate during the survey; By exposing the content of these settlements, their dimensions, and the desired goals through their legislation, which in their entirety serve the desired goal of most countries, which is to circulate a one-month real estate system that guarantees the security of real estate transactions and the rights of owners, not to mention activating the role of real estate at all levels. This study concluded the effectiveness of the vacancy theory in addressing the situation of unclaimed real estate during the survey and reducing the effects of the latter on the real estate itself because of its disruption to its effective role in the national economy.
