الملخص
الملخص: الإجماع هو المصدر الثالث من مصادر التشريع الإسلامي، وموضوعه لم يحترق كما يقال؛ بل لا يزال بحاجة إلى دراسة بعض جوانبه والتي منها إجماع المجامع الفقهية، وهذا النوع من الإجماع يعتبر من مسائل الأصول الجديدة؛ لأنه يتميز بعدة مميزات منها: كونه إجماع مؤسسة اجتهادية، ويلتزم الاجتهاد الجماعي، ولا يتناول إلا النوازل المستجدة فقط، ويضم أهل الاجتهاد الجزئي والخبراء ... نطالع في هذا البحث موضوعا جديدا في أصول الفقه؛ وهو: إجماع المجامع الفقهية، حيث يقع النظر فيه بين تكييفه، وحجيته. تمثلت إشكالية البحث فيما يأتي: إذا اتفقت قرارات المجامع الفقهية على حكم نازلة من النوازل فهل يكون اتفاقها من قبيل الإجماع الأصولي؟ أم هو إجماع الأكثرية؟ أم هو إجماع سكوتي؟ أم هو نوع جديد من أنواع الإجماع؟ انتهى البحث إلى نتائج عديدة من أهمها: أن إجماع المجامع الفقهية إجماع سكوتي تكييفا وحجيّة، لكن بشروط. ABSTRACT : Consensus is the third source of Islamic legislation, and its subject has not been burned, as it is said, it still needs to study some of its aspects, including the consensus of the Islamic fiqh councils. This type of consensus is considered one of the new issues ; Because it is characterized by several advantages, including: it is the consensus of an institution of jurisprudence, adheres to collective ijtihad, and deals only with new updates and problems, and includes the people of partial ijtihad and experts... In this research, we find a new topic in the foundations of jurisprudence. It is: the consensus of the fiqh councils, where consideration falls between its adaptation and its authoritativeness. The research problem was the following: If the decisions of the fiqh councils agree on a ruling that comes from calamities, is their agreement a form of consensus? Or is it the consensus of the majority? Or is it silent consensus? Or is it a new kind of consensus? The research concluded with several results, the most important of which are: The consensus of the fiqh councils is a :silented consensus , adapted and authoritative , but with conditions. .
