الملخص
تعالج هذه الدراسة المسؤولية الجزائية المترتبة على الإتجار غير المشروع بالأدوية ذات الخصائص المؤثرة عقليا، التي ترتكب من طرف المؤسسات الصيدلانية أو الصيدليات، أثناء قيامها بالأعمال الصيدلانية المرتبط بهذا النوع الخطر من الأدوية، عن طريق مخالفتها للأحكام والشروط المتعلقة بالمراقبة الإدارية والتقنية والأمنية للمواد ذات الخصائص المؤثرة عقليا. وتظهر هذه المخالفات في عدم احترام المؤسسات الصيدلانية للأحكام المنظمة لشروط الإنتاج والاستيراد والتصدير للمواد والأدوية المؤثرة عقليا، أو في مخالفة الصيدلي لقواعد وإجراءات اقتناء الأدوية المؤثرة عقليا وحيازتها، أو الإخلال بشروط صرف الأدوية المؤثرة عقليا. مما ينعكس سلبا على الصحة العمومية. Abstract: This study deals with penal liability for illicit trafficking in drugs with mentally influential characteristics. Such acts committed by pharmaceutical enterprises or pharmacies in the course of pharmaceutical work associated with this dangerous type of drug, This offence is committed in violation of the terms and conditions for the administrative, technical and security control of items of mentally affected characteristics. These irregularities are reflected in the failure of pharmaceutical enterprises to respect the rules governing the production, import and export of mentally harmful substances and medicines. Also in violation by the pharmacist of the rules and procedures for the acquisition and possession of mentally harmful drugs, It is also a breach of the conditions for the delivery of mentally harmful drugs. And all of this, of course, has a negative effect on public health.
