أثر الجوار في الفكر الاجتهادي لدى فقهاء المسلمين -العمارة الإسلامية أنموذجا-

الملخص
المقال يتحدث عن الأحكام الفقهية المتعلقة بأحكام الجوار في البناء، وما يجوز للجيران وما يحرم في حقهم في البناء الحضري، ويتكلم عن أحكام المرافق المشتركة وغيرها من جدران البيوت وأبوابها وكيف نظم ورتب الفقه الإسلامي أحوالها بين الساكنة، مراعيا في ذلك العدل والمصلحة موفقا بين مصالح الناس واحتياجاتهم في سكنهم. والهدف من هذا المقال هو إبراز أحكام فقهنا الإسلامي الذي يرافق التمدن والاجتماع، ويحارب العشوائية والفوضى. وكان من نتائج هذا البحث أنّ فقه العمران عند فقهاء المسلمين فقه دقيق يراعي مصلحة المتجاورين ويحترم خصوصياتهم؛ حيث وضع تفصيلات دقيقة جدا لأحكام الجوار والتمدّن، وحل النزاع بين المتجاورين في أدنى صوره وأشكاله. وأن المدن عند المسلمين كانت تقوم على هندسة التخطيط، لا على العشوائية. The article talks about the jurisprudential rulings related to the provisions of neighborhood in construction, and what is permissible for neighbors and what is forbidden in their right in urban construction, and it talks about the provisions of shared facilities and other walls and doors of homes and how Islamic jurisprudence organizes and ranks their conditions among the residents, taking into account justice and interest in reconciling the interests of people and their housing needs. The aim of this article is to highlight the provisions of our Islamic jurisprudence that accompany urbanization and socialization, and combat randomness and chaos. One of the results of this research was that the jurisprudence of urbanism according to Muslim jurists is an accurate jurisprudence that takes into account the interests of the neighbors and respects their privacy; where he put very precise details of the provisions of neighborhood and urbanization, and resolved the conflict between the neighboring in the lowest forms and forms, and that cities for Muslims were based on planning engineering, not on randomness.
