الملخص
ملخص: تناولت الدراسة سلطات واختصاصات مجلس الأمن بين ضرورة حفظ الأمن وانتهاك السيادة، وتبين أن مجلس الأمن هو الجهاز الأكثر نشاطاً والأوسع اختصاصاً، يتمتع بسلطات وصلاحيات واسعة بموجب الفصلين السادس والسابع من ميثاق الأمم المتحدة فيما يتعلق بحفظ الأمن والسلم الدوليين ويقوم بالدور المكلف به من خلال اصدار قرارات وتوصيات في مواجهة أطراف النزاع ويجب عليه في هذا الشأن الالتزام بالضوابط التي نص عليها الميثاق حتى تتصف قرارته بالمشروعية وعدم انتهاك سيادة احدى الدول أطراف النزاع، هدفت الدراسة إلى معرفة مدى قانونية إجراءات المنع والقمع التي يتخذها مجلس الأمن بموجب الفصلين السادس والسابع من ميثاق الأمم المتحدة بين ضرورة حفظ الأمن وانتهاك السيادة الوطنية. توصلت الدراسة إلى عدد من نتائج، أهمها: تعثر قرارات مجلس الأمن في مجال حفظ الأمن والسلم الدوليين برغبات واتجاهات الدول الكبرى الدائمة العضوية بمجلس الأمن. كما تتوقف صحة ومشروعية قرارات مجلس الأمن في حفظ الأمن والسلم على ضرورة الالتزام بالضوابط التي نص عليها ميثاق الأمم المتحدة، ويترتب على عدم الالتزام بطلان القرار وعدم شرعيته. Abstract : The study dealt with the powers and competencies of the Security Council between the necessity of maintaining security and violating sovereignty, and it was found that the Security Council is the most active and broadest specialized body, enjoying wide powers and powers under Chapters VI and VII of the United Nations Charter with regard to the maintenance of international peace and security and the role assigned to it by issuing decisions And recommendations in confronting the parties to the conflict, and he must in this regard adhere to the controls stipulated in the Charter so that his decisions are legitimate and not violate the sovereignty of one of the countries that are parties to the conflict. The study reached a number of results, the most important of which are Resolutions of the Security Council in the field of maintaining international peace and security have faltered with the desires and trends of the major permanent members of the Security Council The validity and legitimacy of Security Council decisions in maintaining peace and security also depend on the necessity to adhere to the controls stipulated in the Charter of the United Nations, and failure to adhere to the nullity of the resolution and its illegality.
