الجرائم ضد الإنسانية وآثارها على تطبيق القانون الدولي الإنساني وتحقيق السلم و الأمن الدوليين

الملخص
تعتبر الجرائم ضد الإنسانية من أخطر الجرائم الدولية التي عرفها الإنسان،نتيجة الحرب العالمية الأولي و الثانية، و التي عان منها كثيرا ،نتيجة لخطورتها وآثارها على البشرية،وخاصة المدنيين العزل،حيث أن هذه الجريمة لها آثار على تطبيق القانون الدولي الإنساني وعلى تحقيق السلم و الأمن الدوليين في العالم،اللذان تسعي الأمم المتحدة لتحقيقهما منذ وجودها،وهدفنا من هذه الدراسة هو بيان هذه الآثار. كما توصلنا إلى نتيجة مفادها أن الجرائم ضد الإنسانية لها آثار سلبية على تطبيق القانون الدولي الإنساني و تحقيق السلم و الأمن الدوليين،من خلال انتهاك الحقوق و الحريات،وعدم تطبيق مبادئ القانون الدولي الإنساني،وعدم احترام المواثيق الدولية وخاصة اتفاقيات جنيف الأربع 1949 وبروتوكوليها الإضافيين 1977. Crimes against humanity are among the most serious international crimes) known to man, as a result of the First and Second World War, and which he suffered greatly, as a result of its gravity and its effects on humanity, especially unarmed civilians. As this crime has implications for the implementation of international es humanitarian law and for achieving international peace and security in the world, which the United Nations has been seeking to achieve since its existence, our aim of this study is to demonstrate these effects. We also reached the conclusion that crimes against humanity have negative effects on the application international humanitarian law and the achievement of international peace and security, through the violation of of rights and freedoms, the lack of application of the principles of international humanitarian law, and the lack of respect for international covenants, especially the four Geneva Conventions of 1949 and their Additional Protocols 1977.
