ضوابط التّنزيل المقاصدي في النّوزال الفقهية الطّبّية

الملخص
للتّنزيل المقاصدي أهمّية بالغة في معالجة النّوزال الفقهية الطّبّية، تساعد الباحث في توظيف المقاصد واستثمارها في فهم أحكام الشّريعة، والأهمُّ منه توجيه النّظر والبحث إلى مسألة التّنزيل المقاصدي لمعرفة شروطه وضوابطه، فكان الإشكال الرّئيس هو الآتي: ما هو التّنزيل المقاصدي، وما هي ضوابطه؟ وأهمّ النّتائج المتوصل إليها جاءت متمثّلة في ما تعلّق بشروط التّنزيل المقاصدي بالنّازلة الطّبّية في حدّ ذاتها، أو ما تعلّق بالمتأهِّل لها، إضافة إلى الضوابط التي تعين الباحث في التّنزيل المقاصدي في النّوازل الفقهية الطّبّية، ودراسة تطبيقية لحالات التّنزيل المقاصدي. Abstract: Al-Maqasdi's application is of great importance in addressing the jurisprudence of medical jurisprudence, helping the researcher in the recruitment of the purposes and investing in understanding the provisions of the Sharia, and most importantly to direct the consideration and research to the issue of Maqasdi's application to know its terms and controls. The main problem is the following: What is the Maqasdi's application, and what controls? The most important conclusions reached were the conditions of application of medical negligence in their own right or those related to them, in addition to the controls that assist the researcher in the application of the principles of medical jurisprudence, and an applied study of the cases of application.
