الملخص
تتمحور فكرة هذا المقال حول نوع من أنواع العموم عند الأصوليين، وهو العموم العقلي من حيث المقصود عند الأصوليين، ومن حيث التفريق، والتقسيم، والتفريع الذي يُظهر الأثر البارز للمسألة في الفقه الإسلامي، والذي تتأتى من خلاله أهميتها، كل هذا بصياغة وطرح جديد مبني أساسًا على إخراج المسألة من طابعها الجمودي الغالب في كتب الأصول، إلى فضاء الاجتهاد والتفريع، لربط الفرع بأصله و تخريجه عليه، و الذي يقوم على البحث و التفتيش عليه في نصوص الشرع، وكتب الفقه الإسلامي و التفسير وشروح الحديث على اختلاف مذاهبها ومدارسها. The essential of this article revolves around a type of fondamentalism among the fondamentalists wich is meant by them the mental general. And in term of differentiation, devision and branching shows the basic impact in islamic jurisprudence. Wich comes through its importance. All of that with new structure based mainly on taking out of the issue from its predominantly aesthetic wich found in the majority of the books to the space of diligence and branching in order to join the branch with its origin, that is based on research in the text of islamic laws and books of islamic jurisprudence, interpretation and explanation of hadith on several doctrines and schools.
