الملخص
لقد راعت الشّريعة الإسلاميّة الوقائع والظّروف زمن التّنزيل، وهو الأمر الذي سار على نهجه فقهاء الصّحابة والمجتهدين في محاولتهم لتنزيل النصّ الشّرعي على الواقع الذي عاشوا فيه، فتخصّصوا في معرفة مجتمعاتهم، وراعَوا أحوال المستفتين الخاصّة وطبائعهم؛ يقينا منهم أنّ الشّريعة ما نزلت على المكلّف لتشقّ عليه. وهذا ما استدعى تسليط الضّوء على أهميّة فقه الواقع، وعلاقته بالنصّ الشّرعي، وكذا آليات تحصيله. Abstract: Islamic law has taken into account the facts that existed in the era of revelation, the Sahaba and scholars followed the same method, they took in consideration the reality of their era, so they understood what is happening in their era and their societies. The Sahaba was not revealed to make difficulties for people. This necessitated highlighting the importance of the jurisprudence of reality, and knowing its relationship with the legal text,as well as the mechanisms of its collection to determine the true understanding of the legal text and its purpose.
