إجراءات استثنائية لمواجهة الجريمة المنظمة العابرة للحدود الوطنية

الملخص
الملخص: تعتبر الجريمة المنظمة العابرة للحدود الوطنية جريمة ذات طبيعة خاصة وخطورة كبيرة على الأمن والاقتصاد الوطني والدولي، لذلك فإن مواجهتها تتطلب استحداث بعض الأحكام الخاصة والاستثنائية، تكفل مواجهتها وملاحقة مرتكبيها وتقديمهم لأجهزة العدالة وتوقيع العقاب عليهم، ومن ثم جاءت ضرورة تعديل الإجراءات الجنائية التقليدية بما يكفل فعاليتها لتحقيق هذه الأهداف. وتتمثل أهم القواعد الإجرائية التي يمكن تطويرها لمواجهة الجريمة المنظمة في تعديل بعض نصوص قانون الإجراءات الجنائية التي تتعلق وتتصل بالتحقيق والمتابعة أو بالمحاكمة، إلى جانب استحداث أساليب تحري خاصة يتم اللجوء إليها على سبيل الاستثناء وفقا للشروط محددة نظرا لخطورتها على حقوق وحريات الأفراد، وفي هذا الإطار فإن اللجوء لهذه الإجراءات الاستثنائية لا يمكن أن يبرر المساس بالضمانات الأساسية التي تكفل حق الفرد في محاكمة عادلة ومنصفة. Abstract: Organized crime is considered a crime of a special nature and a great danger to the national and international security and economy. therefore, confronting it requires the development of some special and exceptional provisions, which combine to confront and prosecute the perpetrators, bring them to the organs of justice and impose punishment on them, and hence the need to amend the traditional criminal procedures to the extent that effectiveness to achieve these goals . The most important procedural rules that can be developed to confront organized crime are the amendment of some texts in code of criminal procedures related to investigation and follow-up or trial, in addition to the development of special investigative methods that are resorted to as an exception according to specific conditions due to their danger to the rights and freedoms of individuals. In this context, resorting to these exceptional measures cannot justify violating basic guarantees, which safeguard the individual’s right to a fair and equitable trial.
