مبدأ الأمن القانوني في مجال الاستثمار

الملخص
لقد نصت المادة 34-4 من الدستور الجزائري لسنة 2020 لأول مرة على مبدأ الأمن القانوني كمبدأ أساسي تخضع له عملية إصدار النصوص القانونية في الدولة في شتى المجالات حيث أن قوام هذا المبدأ يكمن في مفهومين اثنين أو بالأحرى التزامين تخضع لهما السلطة الشارعة هما الوضوح والاستقرار في النصوص القانونية، وعلى ضوء هذا المبدأ يحاول هذا البحث الوقوف على مدى توافق هذا الأخير مع أحد المجالات الأساسية في السياسة الاقتصادية الوطنية وهو مجال الاستثمار. Article 34-4 of the Algerian Constitution of 2020 stipulates for the first time the principle of legal security as a basic principle to which the process of issuing legal texts in the state is subject in various fields, as the strength of this principle lies in two concepts, namely clarity and stability in Legal texts, and in the light of this principle, this research attempts to determine the extent of the latter's compatibility with the field of investment.
