الملخص

يعتبر التقعيد المقاصدي من أهم طرق معالجة ظاهرة التعميم في مباحث مقاصد الشريعة؛ لأنّه يوفّر للمجتهد عددا مهما من القواعد التي تساعده في الإفتاء في النوازل بنظرة مقاصدية منضبطة، ويأتي هذا المقال لدراسة كيفية معالجة بعض جوانب تلك الظاهرة ببيان التقعيد المقاصدي وأثره في ضبط الاجتهاد النوازلي المعاصر، وقد توصلنا من خلاله إلى أن القاعدة المقاصدية أصل صحيح بمثابة اللفظ العام، وأن من خصائصها التجريد والعموم الناتج عن الاستقراء، وأنها تختلف في أوجه عن القاعدة الأصولية والفقهية، كما أن هناك عددا منها له أثر معتبر في الاجتهاد النوازلي المعاصر.
