النّظام القانوني لرخصة الهدم -دراسة مقارنة في التّشريعين الجزائري والتّونسي-

الملخص
الملخّص: إن أشغال العمران لا تقوم فقط على عمليات البناء، ولكن كذلك على عمليات الهدم بغرض إعادة البناء، لذلك وانطلاقا من الإشكالية المتعلّقة بالنظام القانوني لرخصة الهدم في التشريعين الجزائري و التونسي وما يرافق ذلك من فرضيات بخصوص طريقة التّحقيق في ملف طلب الرّخصة والجهات الواجب استشارتها مسبقا قبل اصدارها ،فإن المشرّعين الجزائري والتّونسي نظّم كل منهما عملية الهدم، من خلال تحديد النّطاق الموضوعي الذي يستوجب رخصة الهدم ثم ضبط القواعد الإجرائية والموضوعية، التي تحكم هذه الرّخصة وفقا لما يقرّره القانون.تبدأ من خلال إيداع ملفّ طلب رخصة الهدم أمام الجهة الإداريّة المختصّة -مرفقا في التّشريع التونسي برخص مسبقة- لتقوم هذه الأخيرة بدراسته واستشارة الجهات الإداريّة الأخرى المعنيّة بالرّخصة،وتقرير لاحقا إما قبول الطلب ومنه منح المعني رخصة الهدم مع ما تنتجه الرخصة من آثار قانونية،أو إصدار قرار إداري برفض طلب الرخصة لعدم استيفاء طالب رخصة الهدم الشروط القانونية .وهوما يفتح له لمجال لرفع دعوى قضائية. -و قد اتّبعت في هذه الدّراسة المنهج الوصفي التّحليلي، باعتبار الاعتماد على النّصوص القانونية المختلفة في التّشريعين وتحليلها لاستنباط مختلف الاحكام المتعلّقة الموضوع إلى جانب المنهج المقارن لتبيان مواطن التشابه والاختلاف بين التشريعين. Summary: The construction works are not based only on construction operations, but also on demolitions for the purpose of rebuilding. Therefore, based on the problematic of the legal system for the demolition permit in the Algerian and Tunisian legislations and th accompanying hypotheses regarding the method of investigating the license application file and the parties to be consulted Prior to its issuance, the Algerian and Tunisian legislators each regulated the demolition process, by defining the substantive scope that requires a demolition license and then setting the procédural and substantive rules that govern this license in accordance with what the law decides. It begins by depositing the demolition license application file in front of the competent administrative authority - attached to the Tunisian legislation with prior licenses - for the latter to study it and consult other administrative authorities concerned with the license, and decide later on whether to accept the request and grant the concerned person a demolition license with the legal effects of the license, or The issuance of an administrative decision rejecting the license application because the demolition license applicant does not meet the legal requirements, which opens the way for him to file a lawsuit
