الملخص
يكشف المقال عن الأهمية البالغة التي أولاها المشرع الجزائري لنظام التعويض عن حوادث السير نظرا لخطورتها، ولما تسببه يوميا من خسائر بشرية. يشرح البحث كيفيات حساب التعويض وفقا لهذا النظام الذي منح حماية قانونية لضحايا حوادث السير وذوي حقوقهم. يخلص المقال إلى أن النظام القانوني الحالي المسعر للتعويضات عن الأضرار الجسمانية الناجمة عن حوادث السير رغم نجاعته إلا أنه يحتاج إلى بعض التعديلات، حتى يتماشى التعويض والحالة الاجتماعية والاقتصادية لمستحقيه. The article reveals the extremely importance that the Algerian legislature attaches to the system of indemnity for traffic accidents because of their gravity, it causes daily casualties. The research explains how indemnity is calculated in accordance with this system,which has granted secondary protection to victims of traffic accidents and their rights-holders. The article concludes that, although the current legal regime for indemnity for physical injuries caused by traffic accidents has been effective, it needs some adjustments so that indemnity is in line with the social and economic situation of its recipients.
