الملخص
من ضمن ما سنّ المشرع الجزائري في الحفاظ على قداسة حق الملكية دعوى استحقاق الملكية العقاري، فهي تقوم على فكرة المطالبة بحق الملكية العقارية، ويعتبر البناء فوق أرض الغير من أبرز صور التعدي على الملكية العقاري، إلا أن المشرع الجزائري لم يأخذ بقداسة حق الملكية العقارية على إطلاقه، كما لم يعتبر كل بناء فوق ملك الغير تعديا على الملكية العقارية على إطلاقه Among the things that the Algerian legislator has enacted in preserving the sanctity of the right of ownership is the suit of entitlement to real estate, as it is based on the idea of claiming the right to real property, and building on the land of others is one of the most prominent forms of infringement of real estate ownership, but the Algerian legislator did not take the sanctity of the right to real estate It was launched, just as every building on top of the property of others was not considered an infringement of real estate ownership
