الحريات السياسية في الدساتير العربية بين الضمان والتقييد ( الترشح، الانتخاب والاستفتاء نموذجا )

الملخص
الملخص: إن النّص على حماية الحريات السياسية في الدستور، يعتبر ضمانة مهمة للتمتع بهذه الحريات، غير أن النّص على هذه الحماية قد يقيد الحرية السياسية مباشرة، أو يذكر مبدأ عام يتعلق بالحريات ثم يحيل تنظيمه للقانون الذي يثقله بقيود صارمة، حيث نجد أن معظم الدساتير العربية نصت على حق الانتخاب، والترشح والاستفتاء، غير أن هذا الأخير لم يكن مكفولا للشعب بل هو وسيلة بيد الرئيس فقط، كما وضعت هذه الدساتير قيودا مباشرة على التمتع بالحريات السياسية وحددت بعضها بعبارات يمكن تفسيرها بعدة تفسيرات، زيادة على إحالة تنظيمها للقانون، وهذا ما يجعل الدول العربية بعيدة جدا عن تطبيق مبادئ الديمقراطية ومخلة بقواعد ممارسة الحريات السياسية. الكلمات المفتاحية : الحريات السياسية ; الحريات ; الدساتير العربية ; ضمانات الحريات. Abstract : The protection of political freedoms, which is enshrined in the Constitution as the supreme law in the state that cannot be violated, is an important guarantor for the enjoyment of such freedoms, but the provision for such protection may directly restrict political freedom, or mention a general principle and then refer to its regulation of the law that severely restricts it, since most Arab constitutions provide for the right to vote, run and referendum, but the latter was not guaranteed to the people but by means of the president only, These constitutions have also placed direct restrictions on the enjoyment of political freedoms and have defined some of them in terms that can be interpreted in several interpretations, in addition to referring their regulation to the law, which makes The Arab States far from applying the principles of democracy and violate the rules of the exercise of political freedoms Keywords: Political freedom; Arab constitutions; Freedom; guarantees.
