حماية الطفل من خطر الاستغلال الجنسي للطفل عبر شبكة الانترنت في القانون الجزائري

الملخص
مـلخـص: لا احد منا يمكنه انكار الدور الذي لعبته وسائل المعلوماتية الحديثة في ازدهار وتطوير جميع مناحي الحياة سواء الاقتصادية اوالاجتماعية اوالثقافية، الا انه وبالمقابل ظهر شقي سلبي لهاته التكنولوجيا خصوصا شبكة الانترنت الذي استغلتها عصابات الاجرام في خدمة ميولها المنحرف ولم يميزوا في اضرارهم بالغير بين الراشدين والقصر فاضحت شبكة الانترنت تشكل اكبر خطر يهدد أطفالنا سواء أخلاقيا او صحيا او نفسيا . هذا الخطر الذي حاولت اغلب الدول التصدي له ومحاولة حماية الطفل من ان يقع ضحية له وهذا باستحداث منظومة قانونية صارمة تكفل حمايته، ومنها المنظومة القانونية الجزائرية التي حققت قفزة نوعية وان كانت جاءت متأخرة نوعا ما تمثلت في صدور القانون رقم 15/12 المتعلق بحماية الطفل، خصوصا الطفل في حالة خطر ولا يوجد اخطر من يتعرض الطفل للاستغلال الجنسي عبر شبكة الانترنت بمختلف صوره . لهذا سنتناول في هذا المقال نقطتين أساسيتين هما: - اهم صور الاستغلال الجنسي للطفل عبر شبكة الانترنت . - الآليات القانونية الكفيلة بحمايته من هذا الاستغلال في القانون الجزائري . لنصل في الأخير الى مجموعة من النتائج والاقتراحات لهذه الظاهرة . Abstract: No one of us can deny the role that modern information media have played in the prosperity and development of all aspects of life, whether economic, social or cultural,but in contrast, technology, especially the Internet, which criminal gangs have exploited for their deviant leanings, has shown no distinction between adults and minors. The Internet has become the greatest threat to our children, whether morally, health or psychologically. This is the danger that most countries have tried to address and try to protect children from being victimized by the development of a strict legal system to protect them,the Algerian legal system, which has achieved a qualitative but somewhat delayed leap, was the promulgation of Act No. 15/12 on the protection of children, especially children in danger and there is no more serious risk of sexual exploitation on the Internet in all its forms. This is why we will look at two key points in this article: - The most important images of child sexual exploitation online. - The Legal mechanisms to protect him from such exploitation in Algerian law. Finally, we get a set of results and suggestions for this phenomenon.
