الملخص
يعتبر عقد الفرانشيز آلية فعّالة لنقل التكنولوجيا والمعارف الفنيّة نظرًا لما يتميّز به من المرونة ومسايرته وللتطورات الحاصلة في المجالات الاقتصادية والتكنولوجية، ولأنه يفرض على المانح نقل عناصر التكنولوجيا والمعرفة الفنيّة إلى المرخص له، ويلزمه بتقديم المساعدة الفنية المستمرة لضمان الاستخدام الأمثل لهذه التكنولوجيا. يرجع الفضل في انتشار نظام الفرانشيز في وسط الأعمال إلى المكانة الهامّة التي تحتلها المعرفة الفنيّة وفيه، وفي الحقل الاقتصادي والتي تزداد يومًا بعد يوم في ظلّ عولمة الاقتصاد، وما ينتج عنه من تشجيع للمنافسة والتزاحم في الأسواق، إذ تعدّ من العناصر الجوهرية المكونة لمحله وسمة للاقتصاد في مجال تنمية الإنتاج والتوزيع وحجم الاستثمار. Being an effective and flexible method for distributing products or services, the franchise contract is thus a very important mechanism for transferring technology and technical knowledge to keep pace with development in the economic and technological fields. And the franchiser in transferring his brand’s trademark and technical knowledge to the franchisee, he in the same time obliges him to provide continuous technical assistance to ensure the optimal use of this technology. As technical knowledge has taken center stage in business and in the economic field due to the spread of the globalization of the economy, the encouragement of competition and crowding in the markets, the franchise contract has become one of the essential elements to the economy in the field of production development, distribution and investment.
