اتفاق التحكيم الإلكتروني كآلية لتسوية منازعات عقود الاستهلاك الالكترونية

الملخص
يعتبر نظام التحكيم الإلكتروني في العصر الحديث وسيلة متعارف عليها لتسوية منازعات عقود التجارة الإلكترونية، كونه يتماشى مع الحرية والمرونة التي تتطلبها هذه التجارة وكذلك هروباً من الإشكاليات القانونية التي تثيرها قواعد الاختصاص التشريعي والقضائي التي تختلف أحكامها من دولة إلى أخرى، ويستمد شرعيته من الاتفاق المبرم بين طرفي العقد، غير أن خصوصية عقود التجارة الإلكترونية المتعلقة بالاستهلاك وما يحتاجه المستهلك من تقرير حماية خاصة أثار إشكالية مدى جواز قبول هذا الاتفاق في مثل هذه العقود خاصة في ظل كثرة البيوع الهجومية التي أصبحت تدفع المستهلك إلى التعاقد دون معرفة أو حتى مناقشة الشروط الواردة في العقد، مما جعل هذا الاتفاق في كثير من الاحيان يوصف بالتعسف من جانب المهني، وعليه فإن هذه الدراسة تنصب حول مدى جواز قبول الاتفاق على التحكيم الإلكتروني في عقود الاستهلاك الإلكترونية الدولية. The electronic arbitration system in the modern era is considered as a recognized method for settling disputes in electronic commerce contracts, as it is in line with the freedom and flexibility that this trade requires as well as escaping from the legal problems raised by the legislative and judicial jurisdiction rules whose provisions differ from one country to another. This system derives its legitimacy from the agreement that is Concluded between the two parties, however, the privacy of consumption-related e-commerce contracts and what the consumer needs in terms of a special protection report raised the problem of the extent to which this agreement is acceptable in such contracts, especially in the light of the large number of offensive sales that have become pushing the consumer to contract without knowing or even discussing the terms contained in The contract, which made this agreement described as arbitrariness on the part of the professional; accordingly, this study focuses on the extent of the permissibility of the agreement on electronic arbitration in international electronic consumption contract.
