النظام القانوني لحقوق الطفل و آليات الحماية

الملخص
مما لا شك فيه أن موضوع حقوق الطفل، يعد من أهم المواضيع التي حظيت باهتمام بالغ الأهمية، على الصعيدين الدولي والوطني. إذ أصبحت حماية حقوق هاته الفئة، هدفا تسعى كل الدول إلى تحقيقه، لكون الطفولة هي الأرضية الصلبة لمستقبل كل أمة، وأن كل نهوض بالأمم يبدأ من الاهتمام بالطفل ذكرا أم أنثى، هذا الاهتمام ينصب على عدة مستويات، سواء على مستوى الطفل في ذاته ومستقبل حياته وملامح شخصيته أو على مستوى المجتمع ككل، وعلى مختلف أوجه الحياة فيه . و سنتناول في هذه الورقة التأصيل المفاهيمي و القانوني لحماية حقوق الطفل . وهنا تكمن الغاية الأساسية من تناول هذا المحور من خلال الإشارة إلى القوانين التي تعمد الى حماية الطفل والاعتراف بحقوقه على اعتبار أن الاعتراف الدستوري بعالمية حقوق الإنسان يمثل خطوة هامة في سبيل إعداد قوانين موازية تضمن كرامة الكائن البشري أينما وجد في العالم و خاصة عندما يتعلق الأمر بالطفل، من خلال العمل على ملاءمة النصوص الوطنية مع الاتفاقيات الدولية لحقوق الطفل. وعليه سنحاول إبراز مدى الأهمية التي حظيت به حقوق الطفل في إطار الإصلاحات الدستورية التي عرفها الوطن العربي و التي لا يزال أمامها الكثير لتحقيقه . Abstract : There is no doubt that the issue of the rights of the child is one of the most important topics that has received critical attention at the international and national levels. The protection of the rights of these groups has become the goal of all States, given that children are the bedrock of each nation's future and that the promotion of nations begins with attention to children, whether male or female, at various levels, both at the level of the child and at the level of his or her future life and personality, as well as at the level of society as a whole. In this paper, we will address the conceptual and legal strengthening of the protection of the rights of the child. The main purpose of addressing this focus is to refer to laws that protect children and recognize children's rights. The constitutional recognition of the universality of human rights is an important step towards the elaboration of parallel laws that guarantee the dignity of the human person wherever it is located in the world, especially when it comes to children, by ensuring that national texts are compatible with international conventions on the rights of the child. We will therefore try to highlight how important the rights of the child have been in the context of the constitutional reforms that have been adopted by the Arab world and for which much remains to be done.
