تداعيات فيروس كورونا ( كوفيد 19 ) على عقد النقل الجوي

الملخص
لقد أدّى الانتشار الواسع والمفاجأ لفيروس كورونا (كوفيد19) إلى الإيقاف الكلّيّ للملاحة الجوّيّة عبر العالم، من خلال إغلاق المجالات الجويّة للدّول وكذا المطارات والقواعد الجوّيّة، على نحو أثّر بشكل كبير على قطاع النّقل الجوّيّ من النّاحيّتين الاقتصاديّة من خلال تكبيد النّاقلين الجوّيّين خسائر فادحة، والقانونيّة من خلال عدم إمكانيّة تنفيذهم لالتزاماتهم التّعاقديّة في الآجال المتّفق عليها، ممّا يعرّضهم لتحمّل المسؤوليّة العقديّة، هذه الأخيرة يمكن لهم دفعها بصفة كليّة أو جزئيّة من خلال التّمسّك بأنّ هذا الفيروس شكّل قوّة قاهرة حالت دون إمكانيّة تنفيذهم لالتزاماتهم التّعاقديّة، أو ظرفا طارئا أدّى إلى الإخلال بتوازن عقود النّقل الجوّي، وذلك تبعا للخلاف الفقهيّ الحاصل حول التّكييف القانونيّ لفيروس كورونا (كوفيد19( Abstract: The widespread and sudden spread of Corona virus (Covid19) has led to the complete cessation of air navigation throughout the world, through the closure of the airspace of countries as well as airports and air bases, in a manner that greatly affected the air transport sector in economic terms by inflicting heavy losses on air carriers, and legal By not being able to fulfill their contractual obligations within the agreed deadlines, which exposes them to assume contractual responsibility, the latter can pay them in whole or in part by adhering to the fact that this virus has been a force majeure that has prevented them from being able to fulfill their contractual obligations, or to a temporary condition. Air transport contracts, depending on the jurisprudential dispute over the legal adaptation of the Corona virus (Covid19).
