ضمانات حماية السجناء من استعمال المعاملة أو العقوبة القاسية في المواثيق الدولية

الملخص
الملخص: قد حرصت القواعد الدولية لمعاملة السجناء، على أن لا يزداد الألم من جراء تطبيق النظام العقابي، إلا في حدود ما يفرضه النظام أو تفرضه ضرورة العزل، لكون الحرمان من الحرية هو بذاته مسبب للألم، فممارسة العقوبات القاسية والمعاملات اللاإنسانية يسبب للمسجون ألماً نفسياً وجسديا، ويعتبر إعتداء على الحق في السلامة الجسدية للمسجونين، مما يعكس والإستعداد للعودة للجريمة عقب الإفراج عنه؛ ومن ثم فان هناك علاقة قوية بين الضمانات المقررة للسجين المحكوم عليه والأهداف المبتغاة من العقوبة وجودا وعدما. وقد تم دراسة ضمانات حماية السجناء من استعمال القسوة في المواثيق الدولية في مبحثين متوافقين مترابطين، أسفرا عن أهم التوصيات المتمثلة في فكرة إنشاء منظمة عالمية للإصلاح وإعادة التأهيل الإجتماعي للمسجونين -كوكالة متخصصة مرتبطة بالمجلس الإقتصادي والإجتماعي- بصفتها تمثل الجهاز الدولي القادر على تحمل دور الأمم المتحدة التي أخذت على عاتقها قيادة الحركة الدولية في هذا المجال منذ أكثر من نصف قرن. Abstract : The international rules for the treatment of prisoners have ensured that the pain does not increase as a result of the application of the penal system, except within the limits imposed by the system or imposed by the necessity of isolation, because the deprivation of liberty is itself a cause of pain. An assault on the right to the physical integrity of prisoners, which reflects the willingness to return to crime after his release; Hence, there is a strong relationship between the guarantees established for the sentenced prisoner and the goals sought for the punishment, whether or not. Safeguards for the protection of prisoners from the use of cruelty in international conventions have been studied in two compatible and interconnected topics, which produced the most important recommendations represented in the idea of establishing a global organization for the reform and social rehabilitation of prisoners - a specialized agency linked to the Economic and Social Council - as it represents the international body capable of bearing the role of the United Nations. It took upon itself the leadership of the international movement in this field for more than half a century.
