الملخص
تعتبر المهام الاقتصادية أحد أهم المهام التي كلّف بها الجيش الوطني الشّعبي في الجزائر منذ الاستقلال، حيث شارك في بناء البنية التحتية من مصانع مزارع وطرق، إضافة إلى الصناعات الدّفاعيّة العسكرية واللوجستية، حيث أدت التحولات الإيديولوجية التي شهدتها الدّولة الجزائرية، والتي أثرت كثيرا على مهام الجيش الوطني الشّعبي، إلى تركيز الوظيفة الاقتصادية للجيش الوطني الشّعبي أكثر في الوظيفة الصّناعيّة الدّفاعيّة، وذلك انسجاما مع معطيات الاحتراف العسكري، الذي توجهت نحوه الدّولة الجزائرية، والذي مثّلت فيه المؤسسات العمومية ذات الطّابع الصّناعي والتجاري التابعة للقطاع الاقتصادي للجيش الوطني الشّعبي الركيزة الأساسية، لذلك كان تطور النظام القانوني لهذه المؤسسات يسير بالموازاة مع تطورها التقني العلمي والعملي، وذلك منذ صدور القانون الأساسي النموذجي للمؤسسات الاقتصادية العسكرية سنة 1982، إلى غاية صدور القانون الأساسي النمودجي للمؤسسات العمومية ذات الطّابع الصّناعي والتجاري التابعة للقطاع الاقتصادي للجيش الوطني الشّعبي سنة 2008. وعلى هذا الأساس، فقد حاولت هذه الدّراسة التعرض للجانبين العضوي والموضوعي لهذه المؤسسة من زاوية مختلفة، من خلال الإجابة على إشكالية الطبيعة التنظيميّة والرقابيّة التي تخضع لها هذه المؤسسات العموميّة. Abstract : Economic tasks are considered one of the most important tasks assigned to the People's National Army (PNA) in Algeria since independence, as it participated in building the infrastructure of farms and roads factories, in addition to the military and logistical defense industries, as the ideological changes witnessed by the Algerian state, which greatly affected the tasks of the national authority, the economic function of the PNA's was concentrated more in the industrial defense function, in line with the data of military professionalism for which the Algerian state was Directed, and represented by public institutions of a character. The industrial and commercial sector of the economic sector of the PNA's, the foundation, the main pillar. Therefore, the development of the legal system of these institutions was proceeding in parallel with their technical and practical development, since the issuance of the Model Basic Law for Military Economic Institutions in 1982, until the issuance of the Model Basic Law for public institutions of an industrial and commercial nature affiliated with the economic sector of the PNA's in 2008. On this basis, this study attempted to address the organic and substantive aspects of this institution from a different angle, by answering the problem of the organizational and supervisory nature to which these public institutions are subject.
