الملخص
ملخص يهدف هذا البحث والموسوم بعنوان الضمانات الدستورية لحماية المضبوطات، إلى الوقوف على الحماية الدستورية للممتلكات الخاصة بالأفراد والتي قد تكون محلاً للضبط من قبل الأجهزة والسلطات المختلفة في الدولة، وذلك بهدف حماية الأفراد وممتلكاتهم من تغول السلطات وبيان الحالات التي ترد فيها هذه المضبوطات لأصحابها أو تلك الحالات التي تصادر فيها هذه المضبوطات المملوكة للأفراد، وكذلك نهدف من وراء هذا الدراسة للوقوف على مدى اتساق التشريعات العادية مع القانون الأساسي في هذه الضمانات التي فرضها المشرع الدستوري، وكذلك بيان السبل التي قد يسلكها الأفراد لحماية ممتلكاتهم من تغول السلطة وتعسفها في مصادرة أو إتلاف ممتلكاتهم دون التقيد بالنصوص التي قررها القانون الأساسي. Abstract This research and tagged entitled Constitutional Guarantees for the Protection of seizures aims to identify the constitutional protection of the property of individuals that may be subject to seizure by the various agencies and authorities in the state, to protect individuals and their property from intrusion of authorities and to clarify the cases in which these seizures are referred to their owners or those cases In which these seizures that are owned by individuals are confiscated, and we also aim to identify the extent of the consistency of ordinary legislation with the Basic Law in these guarantees which imposed by the constitutional legislator, as well as to explain the ways that individuals may take to protect their property from the intrusion of the authority and its abuse of confiscating or destroying their property without abide by the texts which established by the Basic Law..
