العدالة التصالحية وأثرها على العدالة الجنائية في التشريع الجزائري

الملخص
التوسع في التجريم أدى إلى الإسراف في استخدام الدعوى العمومية حيث ترتب على هذا التوسع بطء في سير الاجراءات و تراكم للقضايا ما أثقل كاهل القضاء، فظهر ما يعرف بأزمة العدالة الجنائية، ونتيجة لهذه الأزمة اصبحت الأساليب غير القضائية لإدارة الدعوى العمومية ضرورة ملحة لمواجهة هذه المعضلة، فكانت من اهم معالم تطور السياسة الجنائية هو ظهور بدائل للدعوى العمومية، والتي من شأنها تحقيق السرعة في حسم القضايا الجنائية، وإدارة النزاع بطريقة سهلة ومختصرة وتخفيف الضغط عن كاهل القضاء، ونظرا للتطور الذي تشهده الأنظمة الجنائية الحديثة بدأت السياسة الجنائية في محاولة للتحول من عدالة عقابية تقليدية إلى عدالة حديثة تقوم على الرضائية وتهدف إلى إصلاح الجاني والحفاظ على حقوق المجني عليه، ومراعاة البعد الاجتماعي في العلاقات بين الأفراد. The expansion of crimes led to overuse of lawsuits. The fact that resulted a slow rate in the measurements and accumulation of these cases, which has exerted a burden on justice, all the aforementioned led to the emergence of what is called criminal justice crisis. As a result, the non-judicial methods to manage the lawsuit have become a desperate necessity to encounter this dilemma. One of the most significant parameters of criminal policy development are the new alternatives of lawsuits, which can realize a certain speed to end up with the criminal cases and to manage conflicts in an easy and a brief way, to alleviate pressure on justice. Amid the development witnessed by the recent criminal systems, criminal policy is attempting to move toward the traditional punitive justice then to a modern justice based on satisfaction and aiming to reform the criminal and to preserve the rights of the victim, with consideration to the social dimension in the individuals’ relationships.
