المواءمة التشريعية: آلية لعولمة القانون الجزائي

الملخص
تعبر المواءمة التشريعية عن واحدة من أهم آليات عولمة مصادر القانون عموما والجزائي منه خصوصا؛ في الوقت الذي سايرت فيه الجريمة التطورات الاجتماعية والاقتصادية فأضحت مفهوما ذا بعد دولي، يفرض على التشريعات الداخلية، أن تلتزم بقرارات وارشادات المجتمع الدولي، في شأن الحد من مخلفات ذلك التطور، خاصة فيما تعلق منه بالشق الجزائي فوقع على عاتق تلك التشريعات مهمة سن وتحيين نصوصها الداخلية، بما يتماشى والاتفاقيات الدولية، سعيا لتطويق الظواهر الإجرامية المتفشية؛ وفي سبيل ذلك كان لابد من تحقيق العديد من المقتضيات، التي تكفل عملية المواءمة، وأن تحقق وسائلها؛ ليستهدف هذا العمل، معالجة فكرة المواءمة التشريعية، كألية داخلية من شأنها أن تبلور أسسا جديدة لتدويل مصادر القانون الجزائي؛ بمعالجة جوانبها النظرية، ودراسة أبرز مرتكزاتها، وتحديد أهميتها في مواجهة الإجرام العالمي ومكافحته. Legislative harmonization expresses one of the most important mechanisms for globalizing the sources of law in general and the penal one in particular. At a time when the crime was accompanied by the social and economic developments; it has become a concept with an international dimension, which imposes on domestic legislations to abide by the decisions and instructions of the international community in the matter of limiting the remnants of that development, especially with regard to the penal aspect, so it has fallen upon these legislations the task of enacting and updating their internal texts, in line with international agreements, seeking to encircle the rampant criminal phenomena; in order to achieve this, it was necessary to fulfill several requirements that ensure the harmonization process and achieve its means. This work aims to address the idea of legislative harmonization, as an internal mechanism that would crystallize new foundations for the internationalization of the sources of penal law; by addressing its theoretical aspects, studying its most prominent foundations, and determining its importance in confronting and combating the global crime.
