تحليل تطور التأطير القانوني للاستثمار الأجنبي في ظل التوجه والواقع الاقتصادي للجزائر خلال الفترة 1962-2020

الملخص
Abstract: This study attempts to highlight the developments of laws related to foreign investment in the various stages of the Algerian economy, since its inception in 1962 to 2020, and link them with various local and global economic developments. After providing the conceptual framework for the study, various laws related to the regulation of foreign investment were presented and analysed in two main axes related to orientation The planned economy and the market economy, and the most important results have come to the conclusion that attracting this type of investment is mainly related to the financial crises to which the national economy is exposed, without taking it on the basis of an integration component that plans to develop the economy, especially on the structural side. What reflected negatively on the stability of the legal system, and in the end result of the unattractive investment climate in the legal and political apartment. الملخص: تحاول هذه الدراسة إبراز تطورات القوانين المتعلقة بالاستثمار الأجنبي في مختلف مراحل الاقتصاد الجزائري، منذ نشأته سنة 1962 إلى 2020، وربطها مع مختلف تطورات الاقتصادية المحلية والعالمية، فبعد توفير الإطار المفاهيمي للدراسة، تم عرض وتحليل مختلف القوانين المتعلقة بتنظيم الاستثمار الأجنبي ضمن محورين أساسين متعلقين بالتوجه الاقتصاد المخطط واقتصاد السوق، وقد توصلت اهم النتائج أن استقطاب هذا النوع من الاستثمارات متعلق أساسا بالأزمات المالية التي يتعرض لها الاقتصاد الوطني، دون أخذها على أساس عنصر ادماج يخطط لتطوير الاقتصاد خصوصا في الجانب الهيكلي، مما انعكس سلبا على استقرار المنظومة القانونية، وفي محصلتها عدم جاذبية المناخ الاستثماري في شقه القانوني وكذا السياسي.
