المبادئ التوجيهية للعقد

الملخص
كان قانون الإجراءات المدنية الفرنسي (1975) سبّاقا للنص على مجموعة من المبادئ التوجيهية التي تحكم الخصومة المدنية، وقد تأثرت بعض المشاريع الفقهية الدولية (Unidroit) والأوروبية (PDEC) بهذه المنهجية فأوردت هي الأخرى مجموعة من المبادئ التوجيهية للعقد ضمن الأحكام التمهيدية المنظمة للعقد، ولكن الأمر طرح جدلا فقهيا واسعا بين مؤيّد لهذه المنهجية ومعارض لها لاسيما وأن حقيقة هذه المبادئ لم تتضح بعد. ومع ذلك يظهر أن الأمور تتجه إلى الترحيب بهذه المبادئ باعتبارها الخطوط العريضة التي تعبّر عن التصوّرات التي يسعى المشرع من خلالها إلى توجيه العقد الوجهة التي تحقق الأهداف المنتظرة، وهو ما أخذ به تعديل القانون المدني الفرنسي (2016) بصورة محتشمة، ويميل الاتجاه الراجح إلى اعتناق ثلاثة مبادئ جوهرية هي على التوالي: الحرية العقدية، والقوة الملزمة للعقد، وحسن النية، في حين يميل بعض الفقه الحديث إلى اعتناق ثلاثة مبادئ حديثة هي على التوالي: المساواة العقدية، والتوازن العقدي، والتضامن العقدي. The French Code of civil Procedure (1975) was a forerunner of a set of guidelines governing civil litigation, and some international doctrinal projects (Unidroit) and European (PDEC) were affected by this methodology and also provided a set of guidelines for the contract within his provisions. However, there has been a wide debate between supporters and opponents of this methodology, especially since the truth of these principles is not yet clear. However, it appears that these principles are being welcomed as the broad outlines of the vision sought by the legislator.
