الطبيعة القانونية للنظام الرئاسي و دوره في تجسيد قيم الديمقراطية

الملخص
يعتبر النظام الرئاسي من بين أهم نماذج الحكم الحديثة، و قد ظهر هذا النظام في الولايات المتحدة الأمريكية وظل نموذجا لحكمها منذ نشأتها، و في أغلب الحالات جاء ليكون بديلا للأنظمة الملكية بالنسبة للدول التي تبنته في دساتيرها. و يعتمد النظام الرئاسي على دعامتين اثنتين الدعامة الأولى تتمثل في فردية السلطة التنفيذية بحيث تختصر في جهاز رئيس الدولة الذي لا يشاركه في ذلك جهة أخرى و الدعامة الثانية تتمثل في الفصل الشديد بين السلطات والتوازن بينها بحيث تستقل كل سلطة عن الأخرى في أدائها لمهامها، غير أن هذا النظام لا يمثل بالضرورة أداة من أدوات الديمقراطية الحديثة الناجحة في كل الحالات، و حتى مع التسليم بنجاح هذا النظام نسبيا في الولايات المتحدة فهذا ليس معناه نجاحه في كل الدول التي تبنته، بل يعتمد الأمر على المناخ السياسي و الاجتماعي لكل دولة على حدا لأن بعض الدول التي أخذت بهذا النوع من أنظمة الحكم لم تفشل في تطبيقه فحسب بل وصلت إلى نتائج عكسية، ذلك أنها فشلت في تجسيد مبادئه و أسسه بشكله الصحيح. فلا يعتبر النظام الرئاسي مرادفا لقيم و مبادئ الديمقراطية الحقيقية في كل الحالات. The presidential system is considered one of the most important models of modern governance, this system arose in the United States of America and has been a model for its rule since its inception, and in most cases its became an alternative to monarchical systems for the countries which adopted it in their constitutions. The presidential system is based on two pillars. The first is the individuality of executive power, so that it is reduced to the apparatus of the head of state, which is not shared by another party, and the second pillar is the severe separation of powers and the balance between them so that each authority is independent of the other in the exercise of its functions. This system does not necessarily represent one of the tools of a successful modern democracy in all cases, and even given the relative success of this system in the United States, it does not mean its success in all countries that have it. adopted, but rather depends on the political and social climate of each country separately because Some countries that have adopted this type of regime not only failed to implement it, but also had opposite results, as they did not have failed to embody its principles and foundations in its correct form. The presidential system is not considered to be synonymous with the values and principles of a true democracy in all cases.
