أثر إختلاف الدين على التصرفات المضافة لما قبل الوفاة: الهبة ،النفقة ، الوقف

الملخص
يعتبر تأثير إختلاف الدين على الحقوق المالية الناشئة عن التصرفات المضافة لما قبل الوفاة والمتمثلة في الهبة والنفقة والوقف مختلف على حسب نوع الحق المالي. فأثر إختلاف الدين على الهبة غير واضح فهي جائزة شرعا مالم تكن في أمر مخالف للشرع وفي إطار تأليف قلب غير المسلم على الإسلام، أما أثر إختلاف الدين على النفقة فهو غير وارد حتى ولو كانت الزوجة كتابية فلها حق النفقة الزوجية، كما أن نفقة الأولاد واجبة على الآباء فهم جزء منهم، ولا يؤثر إختلاف الدين على جواز نفقة الأقارب. أما الوقف فهو تصرف هام لما له من آثار دينية ودنيوية على العباد، فإختلاف الدين بين القائم بتصرف الوقف والمستفيد منه غير مؤثر على اعتبار أنه قربة في نظر الإسلام ومنه فإن وقف غير المسلم جائز مالم يكن على أشياء محرمة شرعا. إن الموقف القانوني للمشرع الجزائري قد أسسه بالعودة لما تنص عليه مذاهب الفقه الإسلامي في هذه المسائل. The legal position of the Algerian lawmaker has founded return as provided for in the doctrines of Islamic jurisprudence in these matters.
