الضمانات القانونية الموجهة للاستثمار وفق التشريع الجزائري

الملخص
المشرع الجزائري كغيره في كل دول العلم يسعى من أجل وضع قواعد وأطر قانونية تنظم مجال الاستثمار على اختلاف نوعه "صناعي فلاحي سياحي"، وهذا من أجل النهوض بهذا المجال وخلق أريحية لدى المستثمر سواء كان محلي او أجنبي، ومن بين أهم ما يكرسه المشرع في هذا المجال هو وضع ضمانات قانونية وقضائية مبنية على أسس وقواعد موضوعية، وهذا ما كان من خلال أخر تعديل للقانون المتعلق بترقية الاستثمار رقم 16-09، والذي جاء بجملة من الضمانات القانونية والتشريعية والتي علها تكون لبنة لإرساء منظومة قانونية تشجع للاستثمار على وجه عام والاستثمار السياحي على وجه الخصوص. The Algerian legislator, like others in countries of the world, seeks to establish rules and legal frameworks that regulate the field of investment in different domains; "industrial,agricultural, tourism", in order to boost these fields, as well as to create a confortability for the local and foreign investor. thus, among the most important things devoted by the legislator in these domains, is putting legal and judicial guarantees based on objective principles and rules, and this what was done through the latest amendment of the law on investment No. 16-09, which provides a range of legal and legislative guarantees, that constitute a fundamental building block for establishing a legal system that encourages investment in general and tourism investment in particular.
