ظاهرة الهجرة غير الشرعية ماهيتها دوافعها انعكاساتها وآليات المواجهة

الملخص
تتجلى دراسة موضوع هذا البحث حول ظاهرة الهجرة الغير الشرعية في وقتنا الراهن باعتبارها من أهم القضايا المعقدة التي أصبحت تكتسي طابعا عالميا وإجراميا مما دافعت الكثير من الدول سواء كانت المصدرة أو الصادرة لهذه الآفة والمستقبلة لها أن تعكف على دراسة حلولها أي إيجاد الحلول الكفيلة والآليات لمواجهتها على مستوى التشريعات الوطنية والاتفاقيات الدولية واستبعدت هذه الظاهرة للقضاء عليها أو الحد من أثارها عن طريق تضافر جهود كل الدول سواء المعنية بها أو غير المعنية بها رغم تفاقمها وتأثيرها على المجال الاقتصادي والاجتماعي والسياسي والثقافي . ومن النتائج المتوصل إليها إن ظاهرة الهجرة ظاهرة عالمية وغير شرعية وتعتبر من أهم الظواهر التي تحتل مكانة بارزة على مستوى المجتمع سواء كان على الصعيد الداخلي آو الخارجي الأمر الذي استلزم غالبية الدول على الاهتمام بها و التركيز عليها في تشريعاتها سواء كانت منها العامة أو الخاصة وذلك نظرا لخطورتها وأبعادها السلبية على مستوى كل المجالات . The study of the subject of this research on the phenomenon of illegal migration in our time as one of the most complex issues that have become global and criminal nature, which prompted many countries, whether exporting or issued to this scourge and the future to be studying the solutions to find solutions and mechanisms to address the The level of national legislation and international conventions and excluded this phenomenon to eliminate it or reduce its impact through the concerted efforts of all States, whether concerned or non-concerned, despite the aggravation and impact on the economic, social, political and cultural. Among the findings is that the phenomenon of migration is a global and illegal phenomenon and it is one of the most important phenomena that occupy a prominent position at the level of society, whether internal or external, which necessitated the majority of countries to pay attention to them and focus on them in their legislation, whether public or private. Of their seriousness and negative dimensions at the level of all areas.
