حماية الطفل من الإستخدام في المواد الإباحية عبر الأنترنت دراسة تحليلية لإتفاقية الطفل لسنة 1989

الملخص
مع التطور التكنولوجي الهائل الذي شهدته البشرية مؤخرا و الربط الالي لشبكة الأنترنت مع جميع الدول استعملت هذه الأخيرة لأغراض إباحية و إجرامية منها نشر صور و مواد إباحية فاضحة للإستغلال الجنسي للأطفال، و قد حضي الطفل باهتمام كبير على مر العصور على الصعيدين الدولي و الداخلي، فعلى الصعيد الداخلي اتخدت عدة دول جملة من التدابير في هذا الميدان ورصدت عقوبات جزائية لمرتكبي هذه الأفعال التي تسيئ للطفل و تخدش حياءه ففرنسا و ألمانيا و إنجليترا رصدت عقوبات السجن و غرامات مالية في حالات نشر صور للأطفال تخدش الحياء. أما على الصعيد الدولي فقد شهد العالم العديد من الإتفاقيات التي تلزم الدول بتوفير أكبر قدر ممكن من الحماية لحقوق الطفل ومنها إتفاقية حقوق الطفل لسنة 1989 ولعل أهم تلك الحقوق التي أكدت عليها هذه الإتفاقيات حق الطفل في حمايته من أي إعتداء جنسي قد يقع عليه، لما لهذه الإعتداءات من أثار سيئة على نشأة الطفل و صحته و نموه. With the huge technological development witnessed recently by mankind and the automated connection of the Internet with all countries, the latter has been used for pornographic and criminal purposes, including the dissemination of pornographic images and pornographic materials for the sexual exploitation of children. Internally, several countries have taken a number of measures in this field and have provided penal sanctions for the perpetrators of such acts that offend the child and undermine his modesty. France, Germany, and England have monitored prison sentences and fines for cases of child abuse. At the international level, the world has witnessed many conventions that oblige States to provide the greatest possible protection for the rights of the child, including the Convention on the Rights of the Child of 1989. Perhaps the most important of these rights underlined in these conventions is the right of the child to protect him from any sexual abuse that may occur. Assaults have bad effects on the child's origin, health and development.
