الحماية الجزائية لتشغيل القصر في التشريع الجزائري

الملخص

إضافة إلى الحقوق العامة التي منحها و حرص عليها المشرع الجزائري للعامل، هناك فئة خاصة من العمالة تتطلب رعاية خاصة، و تستدعي منح المزيد من الحقوق و الضوابط عند تشغيلها، و ذلك لأسباب عدة منها ما يرجع إلى السن ومنها ما يرجع الظروف الخاصة لهذه الفئة و هي فئة العمال القصر . صادقت الجزائر على مُعظم الاتفاقيات المتعلقة مباشرة أو بصفة غير مباشرة بعمل القصر نذكر منها الاتفاقية الدولية رقم 182 بشأن حظر أسوأ أشكال عمل الأطفال و الإجراءات الفورية للقضاء عليها و المكملة بالتوصية رقم 190، وذلك بموجب المرسوم الرئاسي رقم 2000-387 و من أجل تكريس معايير هذه الاتفاقيات تضمّن تشريع العمل الجزائري و القوانين المكملة له العديد من قواعد الحماية الجزائية للعامل القاصر. Abstract: In addition to the general rights granted by the algerian legislator to the worker. There is a special category of workers requires special care, it needs more rights and controls while hiring it, and this for many reasons, including what is du to age , and some are due to the special circumstances of this category; which is the category of minors workers. Algeria has ratified most of the agreements related directly or indirectly to the minors work. we mention international convention Nº182 for prohibiting the worst forms of child labor, and the immediate actions to eliminate it which it supplemented with recommendation Nº190 and according to the presidential decree Nº387-2000 and to implement these agreements algerian labor legislation and the laws supplementing it included many penal protection rules for the minor worker. key words: minor work- penal protection- labor law- work circumstances- work
